1. Wine Country Lavender – Terms & Conditions

​These Terms & Conditions apply to all customers, website users, product purchasers, workshop and event attendees, facilitators, photographers, and visitors to Wine Country Lavender (“we”, “our”, “us”).

By purchasing from us, attending events, or entering our property, you acknowledge and agree to these Terms.

​2. Delivery & Shipping

We deliver Australia-wide using Australia Post or equivalent carriers.

  • Shipping is calculated at checkout and varies by location

  • Regional areas may incur higher delivery charges than metro areas

  • Orders are generally dispatched within 2–3 business days

  • Estimated delivery time is 3–7 business days, depending on location

  • A tracking number is available once your order has been dispatched via Australia Post

Risk & Responsibility

  • Risk in goods passes to the customer upon dispatch

  • We are not responsible for delays, loss, theft, or damage after dispatch

  • Customers must ensure accurate delivery details are provided

  • We are not liable for parcels marked as delivered or misplaced after delivery by the carrier

 

3. Refunds, Returns & Exchanges

Our products are handcrafted in small batches using farm-grown lavender and natural botanical ingredients.

  • We do not offer returns or exchanges for change of mind

  • Minor variations in colour, scent, or texture are normal and part of the artisan process

If a product is faulty or damaged:

  • Please contact us within a reasonable time

  • After assessment, we may offer a replacement, repair, or refund at our discretion

Your satisfaction matters to us, and we will always assess issues fairly and promptly.

 

4. Health, Product Use & Safety

  • Products are for external use only, unless stated otherwise (e.g. culinary items)

  • Always read ingredients before use and perform a patch test

  • Products are not intended to diagnose, treat, cure, or prevent any medical condition

  • Individuals with allergies or sensitivities use products at their own risk

  • We accept no responsibility for allergic reactions, misuse, or failure to follow instructions

  • Products must be stored safely and kept out of reach of children and animals

H​We remind our customers to carefully assess their individual skin requirements prior to purchasing/using a Wine Country Lavender product. We strongly advise to read accompanying directions and recommendations provided with each product, and to conduct a small patch skin test before applying the product in its entirety.

It is paramount to exercise caution and store our products in a safe place out of the reach of children and pets. Only culinary products are suitable for consumption, and all other products are for external use only. Information provided by Wine Country Lavender and our range of products is not intended to diagnose, treat, cure, or prevent any medical condition. In all instances, we advocate seeking the advice of a qualified healthcare professional for appropriate guidance. Wine Country Lavender is not responsible for any allergies, reactions, or illnesses from any of our products, services, or events, at any time.

 

5. Events, Workshops & Farm Experiences

All workshops, events, photoshoots, and farm experiences must be pre-booked where applicable.

Wine Country Lavender is a working farm environment, and conditions may include:

  • Uneven ground and natural terrain

  • Irrigation systems and farm infrastructure

  • Exposure to weather conditions

  • Bees, insects, and wildlife

  • Seasonal agricultural activity

By attending, you acknowledge and accept these inherent risks.

Attendance & Conduct

  • Only booked attendees are permitted on site

  • Arrival on time is required

  • We may refuse entry or remove any person behaving unsafely, intoxicated, or disruptively, without refund

Participation is at your own risk.

 

6. Third-Party Facilitators, Photographers & Organisers

Where workshops, events, or photoshoots are run by third parties:

  • They operate as independent contractors only

  • They are responsible for safety, insurance, delivery, and participant management

  • They are responsible for all payments, refunds, and customer communication

Wine Country Lavender:

  • Provides venue access only

  • Does not supervise or control third-party activities

  • Accepts no liability for third-party actions, services, or outcomes

Non-Exclusivity

Wine Country Lavender reserves the right to run its own workshops, events, and photoshoots at any time, including those similar in nature to third-party offerings. No exclusivity is granted or implied.

 

7. Photography & Media

Photography and filming may occur on-site during events, workshops, and visits.

We may use general imagery for:

  • Marketing

  • Website

  • Social media

  • Promotional materials

You may opt out of identifiable use by notifying us prior to participation.

Photography Rules

  • Private homestead photography is not permitted

  • Commercial photography requires prior written approval

 

8. Photography Consent (Events/Workshops)

Unless otherwise specified, Wine Country Lavender may use photos/videos of attendees for marketing purposes. If you do not wish to be photographed or included in videos, please note that upon booking or arrival, that you only consent unidentifiable use of your image (non-identifiable/background imagery may still occur).

 

9. Website Use, Privacy & Security

  • Personal data is collected only for order fulfilment and communication

  • We do not sell or share personal data with third parties

  • Payment information is not stored on our systems

  • Data is handled securely through trusted providers

  • Cookies may be used for analytics and website functionality

  • You may disable cookies in your browser settings

We are not liable for indirect or consequential losses arising from website use.

At Wine Country Lavender, customer data is solely used for order processing and to tailor your interaction with us to best suit your preferences. This information is handled using secure technology, facilitated by our trusted hosting and payment providers. We do not disclose or sell these details to any third parties. 

Personal information shared with us is retained for the purpose of providing updates on Wine Country Lavender, exclusively to those who have subscribed to our services ("our mates"). Credit card details are not stored within our systems for added security. ‘Cookies’ may be in use for analytical purposes and assessing website traffic, and you retain the option to decline ‘cookies’ acceptance if preferred.

Wine Country Lavender does not accept liability for any indirect or consequential loss arising out of the use of or connected with its website or for any Wine Country Lavender products or services purchased from its website.

10. Liability, Indemnity & Risk

To the maximum extent permitted by law:

  • All participation, product use, and site visits are at your own risk

  • We accept no liability for injury, illness, death, loss, or damage arising from attendance, product use, or participation

  • You agree to indemnify Wine Country Lavender against any claims arising from your actions or breach of these Terms

Where liability cannot be excluded under law, it is limited (at our discretion) to:

  • Resupply of services, or

  • Refund of amounts paid directly to us

 

11. Property Damage

You are responsible for any damage caused by you or your party to:

  • Crops, plants, or landscaping

  • Buildings or infrastructure

  • Equipment or farm property

We reserve the right to recover full repair or replacement costs, including consequential loss where applicable.

 

12. Photography Etiquette (Guests)

  • We encourage guests to share their experience respectfully on social media

  • Commercial filming or professional shoots require prior approval

  • Photography of restricted or private areas is prohibited

 

13. Force Majeure

We are not liable for delays or cancellations caused by events beyond our control, including:

  • Extreme weather

  • Fire, smoke, or natural disaster

  • Government restrictions

  • Power or supply disruptions

 

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and disputes are subject to NSW jurisdiction.

 

15. Acceptance

By purchasing, attending, or entering Wine Country Lavender, you confirm that you have read, understood, and agree to these Terms & Conditions.

Conditions that apply to all bookings, purchases, visits, workshops, events, and experiences at Wine Country Lavender:

1. Bookings & Payment

  • Full payment is required at the time of booking to confirm attendance.

  • Bookings are only confirmed once payment has been received in full.

  • Prices are in AUD and include GST.

  • Only persons included in the booking are permitted on site.

 

2. Entry & Booking Verification

  • Proof of booking must be provided on arrival.

  • Entry may be refused if booking cannot be verified.

  • Attendees are responsible for ensuring they are aware of booking date, time, and details.

 

3. Cancellations, Refunds & Transfers

  • All bookings are final upon payment.

  • No refunds, credits, or transfers apply for change of mind or inability to attend.

  • We accept no responsibility for costs or losses arising from missed attendance.

  • Where possible, we may offer a transfer to another date at our discretion (not guaranteed).

 

4. Workshop Changes, Minimum Numbers & Force Majeure

  • Workshops and events may be rescheduled or cancelled where minimum numbers are not met or due to circumstances beyond our reasonable control.

  • This includes (but is not limited to) extreme weather, fire risk, natural disasters, government restrictions, or safety concerns.

  • In such cases, we may offer a refund or transfer, depending on booking type and circumstances.

 

5. Arrival, Timing & Participation

  • Sessions commence at the scheduled time and late arrival may result in reduced participation time.

  • Attendees are encouraged to arrive 10–15 minutes early for check-in.

  • No extension of session time is guaranteed for late arrivals.

 

6. Conduct, Safety & Right of Removal

  • Attendees must take reasonable care for their own safety and the safety of others.

  • Wine Country Lavender reserves the right to refuse entry or remove any person who:

    • Is intoxicated or under the influence

    • Acts in a dangerous, disruptive, or unsafe manner

    • Fails to follow reasonable safety instructions

  • Removal may occur without refund where safety or operations are compromised.

 

7. Working Farm Risk Acknowledgement

  • Attendees acknowledge that Wine Country Lavender is a working agricultural property.

  • Inherent risks include uneven terrain, weather exposure, irrigation systems, farm equipment, insects (including bees), and natural environmental conditions.

  • Attendees accept these are inherent risks of participation, and agree they are entering the property voluntarily.

 

8. Assumption of Risk (Insurance-Aligned)

To the extent permitted by law, attendees acknowledge that:

  • They participate at their own risk

  • They are responsible for taking reasonable care for their own safety

  • Wine Country Lavender does not guarantee a risk-free environment due to the nature of a working farm

Nothing in these Terms excludes liability that cannot be excluded under Australian law.

 

9. Liability & Limitation of Liability

To the maximum extent permitted by law:

  • Wine Country Lavender will take reasonable care in providing a safe environment

  • We are not liable for loss, injury, damage, or death arising from participation, except where caused by our proven negligence

  • Where liability cannot be excluded, it is limited to the resupply of services or refund of fees paid directly to us

 

10. Indemnity

Attendees agree to indemnify Wine Country Lavender against any claims, damages, losses, or expenses arising from:

  • Their participation

  • Their negligence or failure to follow instructions

  • Their breach of these Terms

  • Claims brought by third parties as a result of their actions

 

11. Property Damage

  • Attendees must take reasonable care not to damage property, crops, infrastructure, or equipment.

  • Attendees are liable for damage caused by their actions.

  • Recovery may include repair costs and associated loss resulting from damage where reasonably applicable.

 

12. Food, Allergies & Health (Insurance-Aligned Duty of Disclosure)

  • Attendees must disclose relevant allergies or medical conditions where reasonably necessary.

  • While reasonable care is taken, we cannot guarantee an allergen-free environment in a farm setting.

  • We do not accept liability for allergic reactions or health outcomes arising from food or environmental exposure.

  • Attendees with known medical risks must take responsibility for carrying required medication.

 

13. Children & Pets  Supervision

  • Children must be supervised at all times by a responsible adult.

  • Guardians accept responsibility for ensuring children comply with safety requirements.

  • Only pets that are friendly and well-trained are allowed on the premises, and must be on the lead with their owner at all times, and kept away from other guests and animals as required.

 

14. Personal Property

  • Attendees are responsible for their own belongings.

  • Wine Country Lavender accepts no liability for loss, theft, or damage to personal property or vehicles.

 

15. Alcohol, Drugs & Fitness to Participate

  • Attendees must not attend under the influence of alcohol or drugs.

  • We reserve the right to refuse entry to anyone deemed unfit to participate safely.

  • Attendees are responsible for their own fitness to participate.

 

16. Emergency Authority (Insurance Requirement Standard Clause)

  • In the event of an emergency, attendees authorise Wine Country Lavender to seek medical treatment on their behalf.

  • Attendees agree to be responsible for any associated emergency costs incurred.

 

17. Force Majeure

We are not liable for failure or delay in performance due to events beyond our reasonable control, including weather, fire, flood, government restrictions, or other emergencies.

 

18. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

 

19. Acceptance

By booking, attending, or entering Wine Country Lavender, you acknowledge that:

  • You understand and accept these risks

  • You agree to take care for your own safety

  • You accept and abide by these Terms & Conditions in full
